Section 2.1: Legal & Constitutional Foundations
The right to fair trade practices, restitution, and economic dignity is anchored within the broader framework of the Constitution of the Republic of South Africa, 1996, specifically Section 22, which guarantees the right to freedom of trade, occupation, and profession, interpreted alongside the right to property under Section 25. Statutorily, this policy is governed by Section 44 of the Electronic Communications and Transactions Act (ECTA) No. 25 of 2002, which explicitly grants a cooling-off period for online transactions, alongside Section 20 (read with Section 19 and Section 56) of the Consumer Protection Act (CPA) No. 68 of 2008, governing the return of goods and the consumer’s right to safe, high-quality merchandise.
Section 2.2: The Statutory 7-Day ECTA Cooling-Off Period
Under Section 44 of ECTA, any consumer utilizing www.jayexstore.co.za is entitled to a general “cooling-off” period. This right allows the consumer to cancel any transaction for goods purchased through the electronic storefront within seven (7) days after the date of receipt of the merchandise. This cancelation can be executed without any penalty and without providing any reason to Jayexstore management. If the consumer exercises this right, they are legally obligated to return the goods to the store at their own cost, ensuring the items remain in their original, un-tampered packaging.
Section 2.3: Financial Restitution Under ECTA Timelines
When an online shopper executes a valid cancelation under the ECTA cooling-off framework, Jayexstore is statutorily required under Section 44(3) to process a full financial refund of all payments received. This refund must be executed within a maximum period of thirty (30) days from the date the cancelation notice was given. Jayexstore will not apply administrative deductions, processing fees, or restocking penalties to refunds initiated within this seven-day window, provided the physical goods are successfully returned to our designated processing center in an uncompromised condition.
Section 2.4: The CPA Right to Pre-Delivery Inspection
In terms of Section 20, read with Section 19(5) of the Consumer Protection Act, consumers shopping on www.jayexstore.co.za have an explicit right to examine their goods upon delivery. Because digital shopping prevents physical handling prior to payment, the consumer can refuse delivery if the items do not match the material type, quality, or specifications reasonably expected from the digital storefront listing. If the goods are rejected at the point of delivery due to a mismatch, the consumer is entitled to cancel the order without penalty and demand a full refund at Jayexstore’s expense.
Section 2.5: The 6-Month Statutory Warranty Against Defects
Section 56, read with Section 55 of the CPA, creates an implied, automatic statutory warranty on every item sold by Jayexstore. If any item proves to be defective, failed, or unusable for its intended purpose within six (6) months from the date of physical delivery, the consumer has the absolute right to return the item. The consumer holds the sole discretion to choose between three specific remedies: a full financial refund, a direct product replacement, or a comprehensive repair of the item. Jayexstore is legally barred from forcing a store credit or voucher onto a customer who demands a cash refund for a defective product.
Section 2.6: Allocation of Risk and Return Logistics Costs
The legal responsibility for the costs of returning merchandise depends entirely on the statutory trigger for the return. For returns initiated under the ECTA 7-day cooling-off period or due to a customer change of mind, the consumer bears the direct financial cost of courier logistics back to Jayexstore. However, if the return is triggered by a product defect under the CPA 6-month warranty, or because Jayexstore delivered the incorrect items, the entire risk and financial cost of collection and logistics falls completely on Jayexstore.
Section 2.7: Strict Statutory Exclusions from Return Rights
Jayexstore enforces specific exclusions from the right to return and refund, fully aligned with the allowances in South African public health regulations and section 42 of ECTA. Products that have been partially or entirely disassembled, physically altered, or combined with other goods after delivery cannot be returned. Furthermore, for reasons of public health and safety, intimate wear, opened cosmetics, and consumable goods are excluded from returns unless they are found to be defective prior to unsealing. Custom-made or personalized items are similarly excluded from change-of-mind returns.
Section 2.8: Process of Inspection and Quality Assessment
Upon receiving any returned item at our warehouse, Jayexstore reserves the right to conduct a formal technical inspection to determine the root cause of any reported defect. Under CPA guidelines, this assessment must be concluded within a reasonable time frame, not exceeding fourteen (14) business days from receipt. If the inspection reveals that the product defect was caused by consumer negligence, physical abuse, liquid exposure, or unauthorized modifications, the statutory warranty becomes void, the refund request will be denied, and the item will be made available for return to the consumer at their expense.
Section 2.9: Preservation of Original Packaging Rules
While Jayexstore encourages consumers to retain original packaging during the initial warranty periods, Section 56 of the CPA explicitly states that a consumer cannot be denied a refund for a truly defective item solely based on the absence of its original cardboard box or plastic wrapping. However, for returns made under the 7-day ECTA cooling-off period or change-of-mind policies, the item must be returned in its original, resalable packaging with all accessories and manuals included, as the item must be fit to re-enter commercial stock.
Section 2.10: Administrative Protocol for Refund Disbursements
To prevent financial fraud and comply with South African anti-money laundering frameworks, all refunds processed by Jayexstore will be disbursed using the exact same payment channel used to make the original purchase. Payments made via Electronic Funds Transfer (EFT) will be refunded to the verified bank account of origin, while credit card transactions will be reversed directly through our integrated payment gateways (e.g., PayFast, Yoco). Under no circumstances will cash or third-party bank transfers be issued for refunds, ensuring a complete and auditable financial paper trail.
Section 2.11: Handling of Subsequent Structural Failures
If a consumer opts to have a defective product repaired rather than refunded under the 6-month CPA window, Section 56(4) provides an additional layer of protection. If the repaired item fails again within three (3) months from the date of repair, due to the same or a related structural defect, Jayexstore is legally obligated to either replace the item or immediately process a full refund. This statutory mechanism prevents consumers from being trapped in an endless loop of ineffective repairs for a fundamentally broken product.
